Terms of service

Who can use Garfunkel

• You must be at least 18 and able to enter into a binding contract.
• Garfunkel is for professional use: marketers, agencies, researchers and other businesses. It isn’t meant for children.
• You can’t use Garfunkel if you’re barred from receiving services under the laws that apply to you, including US sanctions.

Your account and team

• Give us accurate sign-up details and keep your password safe. You’re responsible for what happens under your account.
• Your work happens in a team. The owner controls billing and can delete the team. Owners and admins can invite and remove people, manage API keys, add money and change team settings. Members can analyze posts, search, chat and export.
• Posts, results, uploads and the balance belong to the team, not to the person who added them. If you leave a team or are removed, what you added stays with the team.
• Tell us right away at support@gar-ai.com if you think someone has used your account or a key without permission.

API keys, the command-line tool and connected apps

• An API key acts for your whole team, with full access, including spending the team’s balance. Keep keys secret, don’t put them in public code, and revoke a key in Settings as soon as you no longer need it. Activity with your key is your responsibility.
• Apps you connect through our MCP server (for example an AI assistant) act with the access you approve: reading only, or reading and submitting work that spends your balance. You can disconnect them in Settings at any time.
• Use the API, command-line tool and MCP server as documented. We may limit how much or how fast you use them, change them with reasonable notice, or retire old versions.

What Garfunkel does

Garfunkel analyzes the posts you give it: links to public TikTok, Instagram and X posts, whole accounts, and files you upload. It returns results such as tags, transcripts, translations, summaries, hooks and comment analysis. We keep improving it, so features can change, and features marked beta may not work as well as the rest.

Your content

• You keep what’s yours. You own the files you upload and anything else you send us, as far as it was yours to begin with. These terms don’t transfer it to us.
• You need the right to send it. Only submit content you’re allowed to use this way. That includes having any permission you need from the people who appear in your uploads, and following the rules of the platforms you link to.
• What you let us do with it. You give us permission to store, copy, process and display your content only to run Garfunkel for you, keep it secure, and do what these terms and our privacy policy describe. That includes sending it to the service providers listed in the privacy policy, who process it for us.
• Webhooks and exports. If you set a webhook address or export results, we send the data where you tell us. What happens to it after that is up to you.

Acceptable use

Don’t use Garfunkel to, or try to:

• Submit content that’s illegal, infringes someone else’s rights, or sexualizes minors in any way.
• Harass, stalk, threaten or dox anyone, build profiles of private individuals, or make decisions about people’s eligibility for jobs, housing, loans, insurance or similar.
• Get more free tries, sign-up gifts or rewards than you’re entitled to, for example with several accounts, devices or addresses, or by inviting yourself.
• Get around billing, spending holds, rate limits, usage limits or any security measure.
• Scrape or copy the site or app by automated means other than the API, command-line tool and MCP server, or overload our systems.
• Resell or offer Garfunkel itself, or bulk access to its results, as a service to others. Sharing results with your clients and colleagues as part of your own work is fine.
• Reverse engineer Garfunkel, or use it to build a competing product.
• Probe or test our security without our written permission. Report security issues to support@gar-ai.com.

We may remove content, cancel work or limit accounts that break these rules.

Free tries and rewards

The free try, the sign-up gift and rewards are offered in good faith and are limited per person, device and day. We may change or end them at any time, and we may refuse or take back any that were obtained by breaking these terms.

TikTok, Instagram and X

• Garfunkel isn’t affiliated with, endorsed by or sponsored by TikTok, Instagram, Meta or X. Their names are trademarks of their owners.
• We get public post, account and comment data through a third-party data provider and download media from the platforms’ public servers. Platforms can change, restrict or remove posts at any time, so we can’t promise that any post or account can be fetched. A post we can’t fetch isn’t charged.
• You’re responsible for using results in a way that respects the platforms’ rules and the rights of the people in them.

Results are automated

Results are produced automatically by machine-learning models, ours and those of providers such as OpenAI. They can be wrong, incomplete or different from one run to the next. Check them before you rely on them, especially before decisions that affect people. Results aren’t legal, financial, medical or other professional advice.

Ownership and licenses

• Garfunkel is ours. We own the service, its software, models, tag lists, design and brand. You get the right to use it under these terms, nothing more.
• Your results. You may use, copy, change and share the results we deliver to you for any lawful purpose, and that permission continues after you stop using Garfunkel. Results of public posts don’t give you rights in the posts themselves, which belong to their creators.
• Shared analyses. The same analysis of a public post may be delivered to other customers who submit that post, as described below. It never says who else asked for it. Results of your uploads stay with your team.
• Aggregated data. We may use statistics about how Garfunkel is used and how it performs (for example counts, error rates and processing times), and de-identified statistics that combine many customers’ tags (for example how common a format or theme is, benchmarks and trends), to improve Garfunkel and in features that show only those aggregates. They never include your content itself, such as your uploads, transcripts or any result that identifies you, your team or a post, and we never sell them.
• Training. We don’t train models on your uploads unless your team opts in, and never on posts fetched from links. Our AI providers process content under terms that don’t let them train their models on it.
• Feedback. If you send us ideas or feedback, we may use them without owing you anything.

How we handle your content

• Raw media is deleted after processing. Videos, images and audio we fetch or you upload are removed as soon as each post is done, whether it worked or not, and an hourly storage cleanup removes anything left behind. We keep the derived results and one small thumbnail per post.
• Analyses of public posts may be reused across customers. If a public post was already analyzed with the same version of our pipeline and the same options, we may give you that analysis, after fetching the post again to check it’s still public and to get fresh numbers. The price is the same either way, and who asked for which post is never shared.
• Uploads are never shared. Media you upload and its results are visible only to your team.
• Training is opt-in, uploads only. We use content to train our own models only if your team opts in, and only your uploads, never posts fetched from links, because we can’t consent for their creators.
• You can delete everything. Owners and admins can delete all of the team’s data from Settings at any time, and single results can be deleted through the API.

Balance and billing

• Work is paid from a prepaid balance shown in dollars. Your balance is prepaid usage credit for Garfunkel, not cash: it can only be spent on Garfunkel, can’t be withdrawn, transferred or exchanged for money, and never expires.
• The signup gift, invite-a-friend rewards, spending rewards and pack bonuses are added to your balance on the same terms. A reward earned on a purchase that is later refunded or charged back may be taken back.
• Purchases are refundable on request at our discretion: write to support@gar-ai.com. If a purchase is refunded or charged back, the balance it added, including any bonus or reward, is removed.
• Estimates are free. The price is set aside when you submit and settled per post; failed or canceled posts are not charged.
• Counting an account’s posts costs 2¢ for every 20 posts that are new to your team. Posts you’ve already counted or analyzed are free. We set the amount aside when you start, charge only for what we find, and give it back as credit when you analyze those posts. Analysis is charged only after you confirm, or within a spending cap you set.
• Prices are in US dollars, listed on the pricing page, and can change. We show the price before you submit. Payments are processed by Stripe.
• If you delete your account or your team, any unused balance is lost.

Suspension and closing your account

• You can stop using Garfunkel at any time, and delete your account or your team from Settings.
• We may suspend or close an account that breaks these terms, puts others or us at risk, or that we must close by law. Where we can, we’ll tell you why and give you a chance to fix it first. If we close an account for breaking these terms, its unused balance may be lost.
• When an account closes, your right to use Garfunkel ends. The sections on ownership, billing, disclaimers, liability, indemnity and disputes still apply.

Disclaimers

Garfunkel is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t promise that Garfunkel will be uninterrupted, error-free or that results will be accurate. Some places don’t allow these disclaimers, so they may not all apply to you.

Limitation of liability

To the extent the law allows, GAR AI isn’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, even if we were told they were possible. Our total liability for all claims about Garfunkel or these terms is limited to the greater of the amount you paid us in the 12 months before the claim, or $100. Nothing in these terms limits liability that the law doesn’t allow to be limited.

Indemnity

If someone makes a claim against GAR AI because of content you submitted or because you broke these terms or the law, you’ll cover our reasonable costs of dealing with it, including legal fees. This doesn’t apply to the extent the claim was caused by us.

Changes to these terms

We may update these terms. For changes that matter, we’ll tell you by email or in the app at least 14 days before they take effect, unless the change is needed sooner for legal or security reasons. If you keep using Garfunkel after a change takes effect, the new terms apply. If you don’t agree, stop using it and delete your account.

Governing law and disputes

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Before starting a claim, write to us at support@gar-ai.com and give us 30 days to try to resolve it. Any claim that isn’t resolved goes to the state and federal courts located in Delaware, and you and we agree to their jurisdiction. If you’re a consumer in a country whose law gives you the right to bring claims at home or other protections that can’t be waived, you keep them.

General

• These terms and the privacy policy are the whole agreement between you and us about Garfunkel.
• You can’t transfer these terms to anyone without our consent. We may transfer them as part of a merger, acquisition or sale.
• If part of these terms can’t be enforced, the rest still applies. If we don’t enforce something right away, we haven’t waived it.
• We aren’t responsible for delays or failures caused by events outside our reasonable control.
• We send notices to the email address on your account. You can send notices to support@gar-ai.com.
